If my golem is exactly at 100% load do I still get penalise. It seems to me that I do a lot less damage the higher the percentage.

Well there is a bonus of sorts for running at a lower load. Not sure on the specifics, but the premise is that the less you have on your golem, the less it has to carry, and the more it can put into it's attacks
